These Terms & Conditions (“Terms”) govern your access to and use of the website at thefixory.com (the “Site”) and the services provided by The Fixory (“The Fixory,” “we,” “us,” or “our”), a licensed Arizona contractor (ROC# 360449), including BINSR repairs, home remodeling, and maintenance (collectively, the “Services”). By accessing the Site or using the Services, you agree to be bound by these Terms. If you do not agree, do not use the Site or Services.
You must be at least 18 years old and able to enter into a binding contract to use the Services. By using the Services, you represent that you meet these requirements and that the information you provide is accurate and complete.
Quotes and estimates provided through the Site or by our team are based on the information available at the time, including any inspection reports, photos, or descriptions you provide. Estimates are not a guarantee of final price. Conditions discovered during the work — including hidden, pre-existing, or code-related issues — may require a change order and adjusted pricing, which we will communicate before proceeding where reasonably possible. The final scope of work and price are governed by the written agreement or accepted quote for your specific project.
We use AI-assisted tools to help parse inspection reports and generate preliminary repair line items and estimates. These outputs are aids to our professional judgment, may contain errors, and are not a substitute for an on-site assessment. All estimates are subject to review and confirmation by The Fixory.
We will make reasonable efforts to perform the Services on the agreed schedule. Timelines are estimates and may be affected by weather, material availability, permitting, access to the property, and other factors outside our control. You agree to provide safe and timely access to the property and to disclose any known hazards or conditions relevant to the work.
You may cancel or reschedule services in accordance with the terms of your specific agreement. Deposits and fees for materials already ordered or work already performed may be non-refundable. Where you have a statutory right to cancel under Arizona law, that right applies notwithstanding these Terms.
We stand behind our workmanship as described in your project agreement and as required by Arizona law and our ROC license (# 360449). Except as expressly stated in a written agreement, the Services and the Site are provided on an “as is” and “as available” basis, and we disclaim all other warranties to the fullest extent permitted by law, including implied warranties of merchantability and fitness for a particular purpose. Materials and products may carry their own manufacturer warranties, which pass through to you.
To the fullest extent permitted by law, The Fixory will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising out of or related to the Site or Services. Nothing in these Terms limits any liability that cannot be limited under applicable Arizona law.

If you create a customer, agent, or vendor account, you are responsible for keeping your credentials confidential and for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms.
The Site and its content — including text, graphics, logos, and the “The Fixory” name and branding — are owned by or licensed to us and protected by intellectual property laws. You may not copy, reproduce, or use them without our prior written permission. Content you upload remains yours, but you grant us a license to use it as needed to provide the Services.
The Site may link to third-party websites or services that we do not control. We are not responsible for their content, policies, or practices.
Your use of the Services is also governed by our Privacy Policy, which explains how we collect and use your information.
These Terms are governed by the laws of the State of Arizona, without regard to its conflict-of-law rules. Any dispute arising out of or relating to these Terms or the Services will be subject to the exclusive jurisdiction of the state and federal courts located in Maricopa County, Arizona, unless otherwise required by applicable law.
We may update these Terms from time to time. When we do, we will revise the “Effective Date” above. Your continued use of the Site or Services after changes take effect constitutes acceptance of the updated Terms.
